Ekiti APC Crisis: Daramola Heads To Supreme Court Over Reps Primary Election

The Court of Appeal sitting in Abuja had last week Friday set aside the judgment of the lower court which nullified the election of Mr. Peter Owolabi of the APC as the winner of the Ekiti North Federal Constituency l seat.

The Court also held that the case instituted against the conduct of October 5 National Assembly primary elections of the APC which produced Mr. Owolabi as the candidate was not filed within 14 days as stipulated by the constitution.

In the judgement read by member of the panel, Justice Emmanuel Agim, the court resolved all the two issued raised for the determination in favour of Mr. Owolabi and affirmed his election.

Justice Agim held that the Apo Area Court which nullified the process that produced Mr. Owolabi lacked jurisdiction to hear the matter since there was also a competent court to do same in Ekiti.

After nullified Mr. Owolabi’s election the lower court had earlier directed INEC to issue certificate of return to PDP candidate, Hon. Kehinde Agboola who came second in the election, polling 25,366 votes behind APC’s Owolabi, who scored 31,532 votes.

Dissatisfied with the Appeal Court judgement, Hon. Bimbo Daramola, an aspirant on the platform of the APC, had appealed to Supreme Court, contending that the party did not hold primary election as stipulated by its constitution.
