Kano Governor’s Lawyer, Wole Olanipekun Rejects Appeal Court’s Bid to Change Contradictory Ruling CTC

The legal team of Abba Kabir Yusuf, the governor of Kano State, has turned down a request from the Court of Appeal Registrar to change some parts of the Certified True Copy (CTC) of the judgment that affirmed Yusuf’s election victory.

The request was made on 22nd of November 2023, a day after the CTC was obtained by the law firm of Wole Olanipekun, SAN, one of the lead counsels to Yusuf.

The Registrar claimed that the CTC contained some “Typographical Errors” that needed to be corrected. However, Olanipekun rejected the request, arguing that the Court of Appeal had no legal authority to alter the judgment after the expiration of the mandatory sixty days granted to it to decide the case.

He also pointed out that the process of issuing the CTC had already consumed seven days out of the 14 days in which Yusuf had to appeal to the Supreme Court, leaving him with only seven days to prepare and file his appeal.

Olanipekun advised the Registrar that any correction in the judgment could be done at the Supreme Court level, and urged him to allow Yusuf to pursue his appeal without any distraction or impediment.

Newsflash Nigeria had on Wednesday reported that the Court of Appeal on Wednesday released another Certified True Copy (CTC) of its ruling on the Kano State Governorship Election barely 24 hours after it brought out the first CTC which contained its Order affirming the election of Governor Kabir Yusuf and awarding N1million against the All Progressives Congress (APC).

The Court of Appeal, which has continued to receive backlashes from Nigerians over the controversial orders, brought out the new certified copy – a 68-page document obtained by Newsflash Nigeria on Wednesday.

In the new ruling, the court backtracked and ordered that the Kano governor should rather pay N1million to the APC as costs.

In the new CTC also, the Court of Appeal in the ruling read by Justice Moore Aseimo Abraham Adumen, said Governor Yusuf’s appeal was dismissed.
