Ekiti Guber Tussle: Supreme Court Delivers Judgment Today

The Supreme Court will today (Friday) deliver the judgment on the appeal filed by the Peoples Democratic Party, PDP and its governorship candidate in Ekiti State, Kolapo Olusola-Eleka challenging the election of Governor Kayode Fayemi.

A five-man panel of the apex court which heard the appeal was led by the acting Chief Justice of Nigeria, Justice Tanko Muhammad.

Appellant in the appeal, the Peoples Democratic Party (PDP) had urged the Supreme Court to reverse the decision of the Ekiti State governorship election petition tribunal and that of the Court of Appeal, which both held that it failed to establish rigging and malpractices in the election that produced Governor Kayode Fayemi.

The PDP insisted that contrary to the decision of the tribunal and the Court of Appeal, all documents front loaded at the tribunal were demonstrated as allowed by law and not dumped on the tribunal as erroneously held by the two lower court.

The Appeal Court, had on Thursday, March 28, in unanimous judgment by a three-man panel of Justices, affirmed the July 28 verdict of the Ekiti State Governorship Election Petition Tribunal which declared Fayemi as the bonafide winner of the July 14, 2018 gubernatorial election in the state.

The panel, led by Justice Stephen Adah, said it had no reason to dislodge the decision of the tribunal that the petition the Peoples Democratic Party, PDP, and its candidate, Prof. Kolapo Olusola-Eleka lodged against Fayemi, lacked merit and deserved to be dismissed.

ln the July 14, 2018 governorship election results in Ekiti State, Kayode Fayemi of APC polled 197,545 to defeat Kolapo Olusola-Eleka of the PDP, who polled 178,130.

Today’s Supreme Court judgment, will lay Ekiti gubernatorial election dispute to rest.
